Although the laws provided that there is presumption of freedom but the practice is the opposite at the ECCC. The Co-Investigating Judges, wished to keep the five persons charged by the ECCC in solitary confinement, pending the outcome of the judicial investigation. The detainees were not allowed any contact with each other. This most directly affected Mr. IENG Sary and Mrs. IENG Thirith who had been married for over 50 years. The Pre-Trial Chamber reversed this measure and allowed the detainees to communicate.
