Application of Command Responsibility

Command responsibility is a form of liability which emerged from the jurisprudence of the post World World War II trials, ad hoc tribunals, and the Rome Statute of the ICC. The IENG Sary Defence challenged its application at the ECCC which was established to bring to trial those who allegedly committed crimes in 1975-1979.
